Georgia Guardian Ad Litem

Sometimes in a divorce or custody case, the court appoints a guardian ad litem to represent the best interests of the children.  The guardian ad litem is usually an attorney who acts as an independent and nonbiased representative for the children.  The role of the guardian ad litem is to investigate the facts and circumstances of the case as they relate to the best interests of the children and to make a recommendation to the court regarding custody.  The recommendation of the guardian ad litem is not binding on the court, and it can be challenged by either or both parents.  However, the recommendation of the guardian ad litem typically carries a significant amount of weight and persuasion.

The Role of the Guardian Ad Litem

Child custody cases can be especially contentious with both parents fighting dearly to protect their parental rights.  For this reason, sometimes the best interests of the children get lost in the mix with one or both parents inadvertently placing their interests ahead of those of their children.  With the appointment of a guardian ad litem, the children have a dedicated advocate who is empowered with the authority to make an independent investigation of the facts and circumstances of the case in order to promote the best interests of the children.  Upon the conclusion of the guardian ad litem’s investigation, a detailed report will be filed with the court along with a recommendation of the parent who should be awarded physical custody of the children.

The Function of a Guardian Ad Litem

It is sometimes said that the guardian ad litem is the “eyes and ears” of the court.  That is to say, the guardian ad litem is able to investigate the intricacies of the case with visits to the parents’ homes and the children’s school.  The guardian ad litem is also authorized to speak with anyone such as teachers, doctors, friends and neighbors who might be able to shed light on the children’s wellbeing.
