Contested vs. Uncontested Divorce

The expression goes that there is no such thing as an uncontested divorce.  This is partly true.  One party is always the Petitioner, and if you’ve come to us to initiate an uncontested divorce, you are our one and only client – we are not your spouse’s attorney.  Georgia law provides numerous grounds for a divorce with the most common ground being that the marriage is “irretrievably broken.”  That is to say that there is no hope for reconciliation.  This ground is considered to provide a no-fault basis for obtaining a divorce.  Once a divorce has been filed, it can proceed as either a contested or uncontested case.  If a case is contested, the parties have not been able to work out an agreement concerning their property division and child support and custody matters if they have children.  On the other hand, if a case is uncontested, the parties have reached an agreement on all matters related to their divorce, and have filed that agreement contemporaneously with their Complaint for Divorce.
